Part A - Definitions

  1. Adelaide SRO. A 71-unit Single Room Occupancy (SRO) housing development of which 70 units are subsidized under the HUD Section 8 Moderate Rehabilitation program.
  2. Agreement to enter into housing assistance payments contract (Agreement). A written agreement between the Operator and AHFC that, upon satisfactory completion of the Rehabilitation in accordance with requirements specified in the Agreement, AHFC will enter into a housing assistance payments contract with the Operator.
  3. AHFC. The Alaska Housing Finance Corporation, the public housing authority responsible for administration of the Section 8 SRO program subsidy.
  4. Annual and Adjusted Income. Please refer to Appendix I.
  5. Annual Contributions Contract (ACC) means the written contract between HUD and AHFC under which HUD agrees to provide funding for a Program under the 1937 Act, and AHFC agrees to comply with HUD requirements for the Program.
  6. Assisted lease (or lease). A written agreement between an Operator and a participant for the leasing of a unit with housing assistance payments provided through a Housing Assistance Payments Contract between the Operator and AHFC.
  7. Contract rent. The total amount of rent specified in the Housing Assistance Payments Contract payable to the Operator by the participant and by AHFC on behalf of the subsidized participant.
  8. Decent, safe, and sanitary. Housing is decent, safe, and sanitary if it meets the applicable HUD Housing Quality Standards (HQS).
  9. Disability assistance expenses. Reasonable expenses that are anticipated, during the period for which annual income is computed, for attendant care and auxiliary apparatus for a disabled participant member and that are necessary to enable a participant member (including the disabled member) to be employed, provided that the expenses are neither paid to a member of the participant nor reimbursed by an outside source.
  10. Drug-related criminal activity means the illegal manufacture, sale, distribution, use, or the possession with intent to manufacture, sell, distribute or use, of a controlled substance (as defined in Section 102 of the Controlled Substances Act (21 U.S.C. 802)).
  11. Drug-trafficking. The illegal manufacture, sale, or distribution, or the possession with intent to manufacture, sell or distribute, of a controlled substance (as defined in Section 102 of the Controlled Substances Act (21 U.S.C. 802)).
  12. Elderly participant. A participant who is a person who is at least 62 years of age.
  13. Eligible individual (individual). An individual who is capable of independent living and is authorized for admission to assisted housing under 24 CFR part 5.
  14. Family. (1) A participant without children; (2) An elderly participant; (3) A near-elderly participant; (4) A disabled participant; (5) A displaced participant; (6) The remaining member of a tenant participant; and (7) A single person who is not an elderly or displaced person, or a person with disabilities, or the remaining member of a tenant participant. For the purposes of this document, family and participant will be used interchangeably.
  15. Full-time student. A person who is carrying a subject load that is considered full-time for day students under the standards and practices of the educational institution attended. An educational institution includes a vocational school with a diploma or certificate program, as well as an institution offering a college degree.
  16. Homeless individual. An individual as described in section 103 of the Stewart B. McKinney Homeless Assistance Act (42 U.S.C. 1130.1 et seq.).
  17. Housing Assistance Payment (HAP). The payment made by AHFC to the Operator of a unit on behalf of an eligible participant, as provided under the Contract. The payment is the difference between the Contract Rent and the tenant rent.
  18. Housing Quality Standards (HQS). HUDs minimum quality standards under the Section 8 moderate Rehabilitation Program. See Sec. 882.404 and 24 CFR 982.401. For SRO housing, see 24 CFR 982.605; and for the Section 8 Moderate Rehabilitation SRO Program under subpart H of this part, see Sec. 882.803(b).   19. HUD 50058. The document produced by AHFC detailing the eligibility of the household. This document will be produced at initial move-in, for each special and annual review and at termination.
  20. Moderate Rehabilitation. Rehabilitation involving a minimum expenditure of $3,000 for a unit, including its prorated share of work on common areas or systems, to upgrade to decent, safe, and sanitary condition and comply with Housing Quality Standards. Improvements are modest in nature and other than routine maintenance.
  21. Medical expenses. Medical expenses greater than 3% of annual gross income, including medical insurance premiums that are anticipated during the period for which annual income is computed, and that are not covered by insurance. AHFC will deduct only those medical costs that exceed three percent of annual gross income.
  22. Monthly adjusted income. One twelfth of annual adjusted income.
  23. Monthly income. One twelfth of annual income.
  24. Net Family assets. Please refer to Appendix I.
  25. Near elderly participant means a participant whose head or sole member is a person who is at least 50 years of age but below the age of 62.
  26. Owner. The Anchorage Neighborhood Housing Services, General Partner, Adelaide SRO Limited Partnership, a not-for-profit housing provider and developer of the Adelaide SRO.
  27. Participant. The eligible family who occupies a SRO subsidized unit.
  28. Social Security Number (SSN). The nine-digit number that is assigned to a person by the Social Security Administration that identifies the record of the persons earnings reported to the Social Security Administration
  29. Single room occupancy housing (SRO). A unit that contains no sanitary facilities or food preparation facilities, or contains either, but not both, types of facilities. 3 Statement of individual responsibility. An agreement, in the form prescribed by HUD, - between AHFC and an individual to be assisted under the Program, stating the obligations and responsibilities of the two parties.
  30. Tenant rent. The amount payable monthly by the participant as rent to Operator. Where Operator supplies utilities (except telephone) and other essential housing services tenant rent equals total tenant payment (TTP).
  31. Violent criminal activity. Any criminal activity that has as one of its elements the use, attempted use, or threatened use of physical force against the person or property of another.
  32. Welfare assistance. Welfare or other payment to families or individuals, based on need, that are made under programs funded, separately or jointly by Federal, State, or local governments.
